No part of this training material may be shared, copied, or resold. We reserve the right to pursue you to the fullest extent of the law should we find any evidence that you have copied, reproduced, or resold our educational materials.

Eligibility
To access or use the Platform, you must be at least eighteen (18) years old and have the authority to enter into this Agreement. Minors are prohibited from using the Platform.

Course Delivery
The Tutorial will be delivered to you online in a digital format (no physical products are shipped). To access the Tutorial Portal, you must create a User Account by providing your name, email address, username, password, and other personal information. You must keep this information confidential. By registering, you agree to provide accurate, up-to-date information and to maintain its accuracy. You are responsible for all activities under your account. If the Provider suspects any information is inaccurate, it may suspend or terminate your access without a refund.

Passwords
Passwords and user IDs for the Program are for individual use only. You are responsible for the security of your password and user ID and all activities under your account. You must notify the Provider immediately if you suspect any unauthorised use of your account. The Provider may require a change of password at its discretion. The Provider is not liable for any loss due to your failure to comply with these provisions.

Refund Policy
As the Tutorial is a digital product, we do not offer refunds. You agree not to dispute the purchase with your financial institution. By agreeing to this, you acknowledge that you require immediate access to the Tutorial, and you will lose the right to cancel once the digital content is available for download or streaming.

Privacy
Your personal data will only be used for administrative purposes related to the course and will not be shared or sold. We may contact you regarding your purchase or for support purposes.

Limited License
By purchasing the Course, you receive a non-exclusive, non-transferable, revocable license to access and use the Course. You may download, store, and print single copies of Course materials for personal use. All intellectual property rights remain with Libby Wells and Ephemeral Studio. Any unauthorised use will result in termination of access without a refund.

Copyright
The material in the Tutorial is protected by copyright and applicable laws. You may not modify, distribute, or use any part of the Tutorial without prior written consent from Libby Wells. Violations will result in termination of access to the Program without a refund.

Legal Disclaimer – Technology
Neither Libby Wells nor Ephemeral Studio is liable for any damages caused by technology failures, including issues with websites, course hosting platforms, or other technology. We are not responsible for delays or suspensions caused by events beyond our control.

Limitation of Liability and Indemnity
We are not liable for any loss or damages, including lost business, data, or profits, arising from your use of the Program. You agree to indemnify Libby Wells and its affiliates from any claims or losses related to your use of the Program.

Entire Agreement
This Agreement constitutes the entire agreement between you and Libby Wells concerning your access and use of the Course.

Waiver
Any waiver of these terms must be executed in writing by an authorised representative of the Provider. A waiver of one provision does not waive any other provision.

Severability
If any term of this Agreement is found to be invalid, the remaining provisions will remain in effect.

General Terms and Conditions – Appointments In Person

  • A deposit is required to secure your booking.
  • The deposit is non-refundable.
  • We require 7 working days’ notice to reschedule your appointment due to extenuating circumstances.
  • Failure to attend your appointment will result in the loss of your deposit and possible cancellation of future sessions.
  • The deposit will be deducted from the total cost of the service on the day of your appointment.
  • All services at Ephemeral Studio are considered an ‘Art form’ and results are subjective. We strive to achieve the best possible outcomes, but we cannot guarantee results.

Tattoo Appointments Terms and Conditions – Appointments In Person
Tattooing is an irreversible procedure, and the final result may differ from a pre-drawn design. Artists may adapt the design as they work, ensuring the best results. By booking your appointment, you accept these terms and acknowledge the risks involved. You must be over 18 to book a tattoo, and proof of age is required.

Artwork Commissions Terms and Conditions
A deposit is required to start work on any artwork commission, which is non-refundable. Final payment is due upon collection of the artwork. Commissions are bespoke, and the outcome is subjective. By placing an order, you agree to these terms and understand the risks involved in commissioning artwork. Artworks should be cared for properly and protected from sunlight, moisture, and other damaging factors.

    All prices are listed in UK Sterling and include any applicable taxes. Payment is required at the time of purchase.

  4. Educational Books
    Please note that all educational books are strictly non-refundable. This is due to the nature of the content, which cannot be returned.

  5. Returns and Exchanges
    Exchanges are not possible for educational materials due to their nature. 

  6. Damaged or Incorrect Items
    If you receive an incorrect item, please contact us within 3 days of receiving your order. We will arrange for a replacement or a refund, as appropriate.
